Terms of Service

Welcome to CliffsList.fun. These Terms of Service govern your access to and use of CliffsList.fun and related products and services, collectively, "CliffsList."

By accessing or using CliffsList, you agree to these Terms.

Eligibility

You must be 18 years of age or older and legally able to enter into these Terms to use CliffsList.

You may not use CliffsList if we previously suspended or terminated your account unless we give you permission.

What CliffsList Is

CliffsList is a platform that helps people discover events, share what they're doing, interact with other users, and connect with people.

CliffsList does not operate, supervise, verify, endorse, or control users, events, venues, organizers, ticket sellers, or real-world interactions unless we expressly say otherwise.

We are not responsible for the conduct of users or third parties, online or offline.

Your Account

You are responsible for your account and activity through it.

You agree to provide reasonably accurate information and keep your account secure.

You may not impersonate another person, create accounts for fraudulent purposes, or use another person's account without authorization.

We may refuse, restrict, suspend, or terminate accounts or access to features when we reasonably determine it is appropriate to operate or protect CliffsList, our users, or third parties, enforce these Terms, or comply with law.

Your Content

You retain ownership of content you create and post.

By uploading, posting, submitting, tagging, transmitting, or otherwise making content available through CliffsList, you grant CliffsList a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, adapt, format, publish, display, distribute, communicate, and otherwise use your content as reasonably necessary to operate, provide, improve, secure, develop, and promote CliffsList and its features.

This includes displaying your content to other users and creating different technical or visual formats of it for features such as feeds, profiles, previews, and sharing.

You represent that you have the rights and permissions necessary to provide your content and grant us these rights.

You are responsible for content you post involving other people. Do not post private information or content you do not have the right to use.

Public Content

CliffsList includes public social features.

Depending on the feature, your:

  • profile
  • photos
  • Stories
  • Fun List
  • username
  • bio
  • interests
  • responses or other designated content

may be visible to other users or the public.

You are responsible for deciding what you post to public portions of the service.

Prohibited Conduct

You may not use CliffsList to:

  • harass, stalk, threaten, abuse, or harm another person;
  • impersonate or intentionally deceive others;
  • scam, defraud, spam, or solicit money improperly;
  • post unlawful, infringing, abusive, or unauthorized content;
  • disclose another person's private information without authorization;
  • interfere with or attempt to compromise the service;
  • scrape or access the service through unauthorized automated means;
  • circumvent security or access controls;
  • use CliffsList for unlawful activity; or
  • violate the rights of CliffsList, another user, or a third party.

We may remove content or restrict accounts at our discretion, subject to applicable law.

Events

Event information may come from organizers, venues, ticket providers, public sources, third-party platforms, or other sources.

CliffsList does not guarantee the accuracy or availability of any event information.

Dates, times, venues, performers, admission requirements, availability, prices, ticket links, and other information can change.

You should independently verify important event details before attending or purchasing anything.

CliffsList is not responsible for event cancellations, ticket purchases, refunds, venue conditions, organizer conduct, injuries, losses, or disputes arising from events or third-party services.

Other Users and Real-World Interactions

You are solely responsible for your interactions with other users.

CliffsList does not guarantee any user's:

  • identity;
  • age;
  • background;
  • intentions;
  • statements;
  • conduct;
  • compatibility; or
  • safety.

Unless expressly stated otherwise, we do not conduct comprehensive background checks or independently verify user claims.

Reporting, blocking, moderation, or other safety tools do not constitute a guarantee that another person is safe.

You assume the risks associated with communicating with, sharing information with, attending events with, or meeting other people through CliffsList.

Messaging

Messages are communications between users. We are not responsible for statements, offers, representations, or conduct occurring through messaging.

We may restrict access to messaging or take action regarding messages where permitted or required to operate and protect the service or comply with law.

AI Features

CliffsList may use artificial intelligence to generate suggestions, text, classifications, recommendations, stickers, or other content.

AI output may be inaccurate, incomplete, inappropriate, or incorrect.

You are responsible for reviewing and deciding whether to use or publish AI-generated material.

We do not guarantee AI output.

Third-Party Services

CliffsList may contain links or integrations involving Instagram, ticketing providers, event platforms, maps, or other third parties.

We do not control those services and are not responsible for their content, availability, security, policies, transactions, or conduct.

Your use of third-party services is governed by their own terms and policies.

Changes to CliffsList

We may modify, add, remove, suspend, restrict, or discontinue features or portions of CliffsList at any time, subject to applicable law.

We do not guarantee that any feature, account, Story, event, message, or other content will remain available.

Assumption of Risk

To the fullest extent permitted by law, you voluntarily assume risks associated with your use of CliffsList, including risks related to:

  • communicating with strangers;
  • sharing personal information;
  • meeting people;
  • attending events;
  • visiting venues;
  • purchasing tickets or services;
  • relying on user-generated content;
  • relying on event information; and
  • other online or offline activity resulting from use of the service.

Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, CLIFFSLIST IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We disclaim warranties including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, security, availability, and uninterrupted or error-free operation.

We do not warrant the accuracy of users, events, recommendations, AI output, third-party information, or content.

Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CLIFFSLIST AND ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OPPORTUNITIES, GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO CLIFFSLIST.

To the fullest extent permitted by law, our total aggregate liability arising from or relating to CliffsList will not exceed the greater of:

  • $100; or
  • the amount you paid CliffsList during the 12 months immediately preceding the event giving rise to the claim.

These limitations apply regardless of the theory of liability and even if we were advised that damages were possible.

Nothing in these Terms limits liability where applicable law prohibits doing so.

Release

To the fullest extent permitted by law, you release CliffsList and its affiliates from claims arising from disputes or interactions between you and another user, event organizer, venue, ticket provider, or other third party, except where applicable law prohibits such a release.

Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless CliffsList and its affiliates, owners, officers, directors, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable costs arising from:

  • your content;
  • your conduct;
  • your use or misuse of CliffsList;
  • your violation of these Terms;
  • your violation of law; or
  • your violation of another person's rights.

Intellectual Property

CliffsList and its software, branding, designs, interfaces, technology, and materials provided by us are owned by or licensed to us.

Except for rights expressly granted in these Terms, we reserve all rights.

Termination

You may stop using CliffsList at any time.

We may restrict, suspend, or terminate your access as permitted by these Terms and applicable law.

Provisions that by their nature should survive termination continue after termination, including content licenses, intellectual-property provisions, disclaimers, releases, indemnification, liability limitations, and dispute provisions.

Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Changes

We may update these Terms. When legally required, we will provide appropriate notice.

Your continued use of CliffsList after updated Terms become effective constitutes acceptance to the extent permitted by law.
